On March 31, 2006, Women’s College Hospital separated from Sunnybrook and Women’s College Health Sciences Centre (now known as Sunnybrook Health Sciences Centre) after an eight-year merger. As part of this de-merger and effective April 1, 2006, Women’s College Hospital became an independently governed public hospital and Women’s College Hospital Foundation was re-established as its supporting foundation.
Issues in the de-merger included clarifying the rights and obligations of all parties with respect to employee entitlements, including unionized and non-union staff. The merger and the de-merger were both complex transactions involving governmental, public and private stakeholders and the reorganization of multiple bargaining agents, bargaining units, non-unionized staff and executives.
McCarthy Tétrault LLP advised Sunnybrook with a team led by Brian Smeenk.
