On November 5, 2009, Mindanao Gold acquired Apex Mining Company and all other related assets from Crew Gold Corporation for US$7 million.
The agreement called for total cash payments of US$1 million upon signing of the agreement, US$5 million upon completion, and a final US$1 million when Philippine regulatory approvals are obtained.

McCarthy Tétrault advised Mindanao with a team that was led by Cameron Belsher and Sam Adkins.
