François Xavier is an associate in the Litigation and Bankruptcy & Restructuring groups of the Montreal office. His practice focuses on bankruptcy, insolvency, restructuring, civil and commercial litigation, class actions and banking law. François Xavier participates in the resolution of a variety of disputes involving financial institutions, as well as small and large businesses before the Quebec courts. 

François Xavier has recently participated in the following matters: 

  • Acting for debtor companies and financial institutions in restructuring proceedings under the Companies Creditors Arrangement Act;

  • Acting for financial institutions, corporations and trustees in receivership proceedings under the Bankruptcy and Insolvency Act;

  • Acting for financial institutions in commercial disputes, including interim, interlocutory and permanent injunctions;

  • Acting for directors and officers in complex litigation, including commercial disputes, oppression litigation;

  • Acting for property owners in construction defects and defective work litigation involving construction contractors and professionals;

  • Acting for a multinational corporation in environmental contamination disputes;

  • Acting for the provisional administrator of a guarantee plan for new residential buildings appointed by the Régie du bâtiment du Québec in arbitration and Superior Court proceedings; 

  • Acting for corporations and financial institutions in class actions alleging violations of the Consumer Protection Act; and

  • Acting for professionals in professional liability matters, civil suits and disciplinary proceedings. 

François Xavier was called to the Quebec Bar in 2022 and obtained bachelor’s degree of civil law (LL.B.) from the Université de Montréal. He also holds a masters degree in business law (LL.M.) from the University of Toronto. 

During his bachelor’s degree, he participated in a student exchange program at the China University of Political Science and Law in Beijing. Seeking to deepen his knowledge of the law, he drafted a bill that earned him a place as a finalist in a law drafting competition.

François Xavier was also part of Université de Montréal’s competitive rowing team during his bachelor’s degree.
