Changes to the Public Holiday Pay Calculation in Ontario

As part of the ongoing Changing Workplaces Review, Ontario will be assessing its public holiday system under Part X of the Employment Standards Act, 2000 (“ESA”). Until this assessment is complete, public holiday pay will revert back to its pre-Bill 148 calculation:

(Total Employee’s Regular Wages + Vacation Pay Payable for the 4 weeks prior to the holiday) ÷ 20

This change will take effect July 1, 2018.

For more details on this change, please refer to Ontario Regulation 375/18 made under the ESA.

If you have any questions about this change and how it will impact your workplace, please do not hesitate to contact one of the members in our Labour & Employment group.
