Presented by the McCarthy Tétrault Advance™ program, this training session was held on Wednesday February 16, 2011 in Montréal.
In this conference, our speakers presented a case law relating to class actions brought by groups of members that can be described as "national", or even "North American", is constantly developing. They mainly addressed this subject by the following questions:
What are the general trends relating to the validity of such class actions?
- Are judgments rendered in the province of origin recognized in the other provinces and states affected by the class action?
- How should numerous national class actions on the same subject be managed? As plaintiff? As defendant? By the judiciary?
