Caroline Zayid is a partner in our Litigation Group in Toronto, and is the firm's Litigation National Practice Group Leader. She leads the firm’s national litigation practice, and has responsibility for the bankruptcy and restructuring, international trade, intellectual property, environmental law and research lawyers across the country.

Ms. Zayid represents defendants involved in complex, multi-jurisdictional class action litigation. Her experience includes:

  • Representing auto-parts manufacturer in multi-jurisdictional product liability class actions
  • representing pharmaceutical company in product liability litigation following drug`s withdrawal from Canadian market;
  • representing a leading Canadian bank in consumer class action relating to mortgage charges;
  • represented shoe manufacturer in class action questioning representations about product benefits;
  • represented the manufacturer of a glucose monitoring device in a class action alleging defects in the product;
  • representing governments of seven Canadian provinces in Hepatitis C class action settlement;
  • successfully represented a major automobile manufacturer in class action to defease liability for retiree health care benefits;
  • successfully resisted certification on behalf of a mutual fund company in a class action alleging damages arising from market timing;
  • successfully defended SNC-Lavalin in a securities class action relating to Bre-X Minerals, including the first Ontario ruling dismissing “fraud on the market” theory;
  • acted on behalf of the Province of Ontario in the class action commenced as a result of the contamination of water in Walkerton, Ontario;
  • acted on behalf of the owners of toll Highway 407 in a class action concerning late fees;
  • defended Merck in class actions arising from the withdrawal of its product, VIOXX®; and
  • defended National Money Mart in class proceedings concerning the applicability of the Criminal Code’s interest provisions to payday loan fees.

She has also advised clients facing product recalls and other product liability issues.

Ms. Zayid's practice includes litigating administrative law issues related to the regulation of patented medicines. Her administrative law experience also includes work in the fields of public law and professional regulation.

Ms. Zayid acted on behalf of the Canadian Human Rights Commission in the first successful prosecution of a case concerning promotion of hatred on the internet. She also led the prosecution of the first Ontario case in which a teacher’s certificate was revoked for political activities outside the classroom found to be incompatible with the professional obligations of a teacher.

Ms. Zayid is a contributing author to Defending Class Actions in Canada and Doing Business in Canada.

Ms. Zayid is recognized as a leading lawyer in the area of product liability litigation in the current edition of Chambers Canada. She also appears in the current edition of the Canadian Legal Lexpert Directory as a leading lawyer in the areas of class actions, public law litigation, and professional liability.

Between 1993 to 1995, Ms. Zayid served as a special advisor to the Ontario Minister of Education and Training on legislative matters. For several years, she taught trial advocacy at the University of Toronto Law School and was formerly an instructor in the Ontario Management Development Program at George Brown College. Ms. Zayid has also spoken on legal issues in Canada and the United States.

She received her LLB in 1988, from Dalhousie University. Ms. Zayid was called to the Ontario bar in 1990.
